Online Gaming: Brussels raises its voice!

The Belgian kingdom, following in the footsteps of it's French big brother, has prepared a law concerning the regularisation of the online gaming market in Belgium. This project which follows the main outlines of the French legislation in certain branches of the online gaming industry in France, based essentially on the very controversial judicial principle of subsidiarity. In other words , the Belgian authorities planned to open the Belgian market in online gaming exclusively to Belgian operators by putting forward this famous subsidiarity, according to which Belgian consumers, despite global European agreements, would be covered above all by Belgian legislation.

On the French side, things are similar although a bit vague, according to the declarations from Bercy but above all certain gaps in the proposed law thought up by Eric Woerth, only French operators will be able to benefit immediately from a users licence and to share in the French body of online players. For european operators the task will be more difficult and without a doubt one will have to wait several months before being able to even apply for a licence. This is in any case what the French operators, as was asked by Patrick Lelay, ex- Chairman and CEO of TF1 and who now is director of SPSbetting (TF1-Bouyges-Eurosport consortium), have asked for putting to the fore the marketing  and technology of certain European operators, such as Tropez Casino or Titan Poker, respectively leaders in their markets for several years.

The European authorities have recently rejected the Belgian proposed law like they did at the beginning of June 2009 with the French proposal, invoking a flagrant attempt to clearly violate the community treaty. The Belgian and French legislators must therefore review their respective drafts in order to adapt their markets to the norms dictated by Brussels.
