Poker: a bad hand for the Swiss casinos

“One person's unhappiness is happiness for another”. This could be the thought for the day in Switzerland especially for lovers of poker. In fact, from now on poker fans can take part in Texas hold'em poker  and other types of tournaments with money bets outside of Swiss casinos. The casinos were rejected by the courts which declared that poker isn't in any case a game linked to chance but to the intellectual capacity of the player. So, the judges of the federal administrative court have authorised tournaments with real money ( unlike games with false money, editor's note) even outside the setting of a casino. To summarize, poker games are permitted in Switzerland and the casinos don't have the monopoly of organising poker poker.jpgtournaments with real money. The Swiss Casino Federation brought a case against the Federal Commission of Gaming Establishments (CFMJ) which organised a hundred tournaments and the courts ruled in favour of the CFMJ.

The gaming establishments are rubbing their hands with glee at being able to organise poker tournaments outside casinos and the federal administrative court has proven right those who claim that the game of poker is a game that isn't based on chance. In fact, in poker chance only comes into  it with the distribution of the cards and for the rest, calculating probabilities, strategy, the ability to bluff come into play and are specific to the players. Professional poker players are often found at the final table of the WSOP or the EPT because this game requires good intellectual and physical aptitudes. There are exceptions to the rule notably poker players who have come to notice like Chris Moneymaker, an unknown player, who acquired his place in the world of poker by winning the 2003 WSOP Main Event. This player won the most sought after bracelet in the world  and proved that amateur players also have a chance in poker against the professionals.

The court decision will boost the morale of all the Swiss casinos which don't have the monopoly of poker tournaments. Poker players will be able to sit at a table and play without worrying whether it's legal or not. The Swiss casinos will be able to return to the federal court to appeal the TAF's decision unless it's just a bluff. To be continued...
